2. Principle
We only process personal data insofar as this is necessary for the operation of this website and for processing your enquiry. The legal bases are Art. 6 para. 1 lit. b GDPR (initiation and performance of a contract), Art. 6 para. 1 lit. f GDPR (legitimate interest in the secure operation of the website) and, insofar as expressly granted, Art. 6 para. 1 lit. a GDPR (consent).
3. Hosting and Server Logs
This website is hosted in Switzerland. The European Commission has determined that Switzerland provides an adequate level of data protection; a transfer is therefore permitted without additional safeguards.
When accessing the website, the server automatically collects access data and stores it in log files:
- IP address of the requesting device
- Date and time of access
- Name and URL of the retrieved file
- transferred data volume and message regarding the success of the retrieval
- previously visited page (referrer)
- browser and operating system used
These data are used exclusively for secure operation, troubleshooting and defence against attacks. They are not merged with other data sources and are deleted after 30 days at the latest. Legal basis: Art. 6(1)(f) GDPR.
4. Forms on this website
4.1 Initial contact
In the „Contact - Enquiry“ form, we collect your name, email address, subject and message. We use this information exclusively to answer your request. Legal basis: Art. 6 para. 1 lit. b GDPR, or for general enquiries Art. 6 para. 1 lit. f GDPR.
4.2 Initial contact form
The initial contact form is aimed at prospective tenants for one of our flats. We use it to collect information about you and your contact details, your household and desired move-in date, your professional situation, your income and financial situation, your current living situation, as well as voluntary comments and documents attached by you.
The purpose of the processing is to check whether a viewing and, subsequently, a tenancy is being considered. The legal bases are pre-contractual measures at your request (Art. 6 para. 1 lit. b GDPR) as well as your consent (Art. 6 para. 1 lit. a GDPR), which you grant in the form.
With the exception of the requested item, name and email address, all details are voluntary. However, incomplete information may mean that we are unable to process your request fully.
If no tenancy agreement is concluded, we will delete your details and the documents submitted as soon as they are no longer required for the selection process, but at the latest six months after its completion. If a tenancy agreement is concluded, the details will become part of the tenancy file and are subject to commercial and tax law retention periods.
4.3 Dispatch by email
Form submissions are sent to us by email at mail@swifina.com and are stored there as part of our usual business correspondence. If you send us the completed PDF form by email yourself, the same applies. Please note that unencrypted email does not offer complete protection against interception by third parties.
5. Spam protection (Akismet)
To detect unwanted form submissions, we use the Akismet service provided by Automattic Inc., USA. The form data, including your IP address and browser user agent, is transmitted to Akismet and checked there. The legal basis is our legitimate interest in preventing spam (Art. 6(1)(f) GDPR). Data transfer to the USA is based on standard contractual clauses.
6. Cookies
This website uses technically necessary cookies, such as for session management, spam protection and language selection. These cookies are required for the operation of the website; the legal basis is Section 25(2) of the German Telecommunications and Telemedia Data Protection Act (TDDDG) in conjunction with Article 6(1)(f) of the GDPR. You can delete or block cookies at any time via your browser settings; however, certain functions of this website may then no longer be available.
